Right to Usage Policy

This Rights to Usage Policy ("Policy") governs the access and use of the OmVe unified communications platform and its associated services (the "Platform"). By accessing or using the Platform, you ("User") agree to comply with this Policy.
1. Permitted Uses
1.1. Authorized Communication:
The Platform may be used for voice, SMS, fax, and email communications, including telemarketing and broadcasting campaigns, within the scope of the Platform's features.
1.2. Campaign Management:
Users with appropriate roles (as defined in the Multi-Level User Management system) are permitted to manage, monitor, and run campaigns independently, according to their assigned permissions.
1.3. AI-Powered Call Center Features:
Users may utilize the Platform's AI-powered call center functionalities, including auto-dialling modes (power dialing, predictive dialing, press 1 support, and dynamic dialling), inbound and outbound calling features, and integration with third-party applications via REST API.
1.4. IVR and Survey Tools:
Users are permitted to use the IVR Studio/Designer for creating custom IVR messages and to utilize the survey campaign features for conducting voice-based surveys.
1.5. Personalized Communication:
Users may employ personalized communication features, including custom tokens in email, SMS, and IVR messages, to enhance client interaction.
1.6. Billing and Payment:
Authorized users may utilize the REST-based API for billing and payment processes, subject to the Platform's integrated prepaid billing system.
1.7. Monitoring and Reporting:
Users with appropriate permissions may access and utilize the Platform's campaign monitoring and reporting features.
2. Prohibited Uses
2.1. Illegal Activities:
The Platform shall not be used for any illegal, fraudulent, or unethical activities, including but not limited to:
- Harassment or abuse of any individual or entity.
- Distribution of unsolicited commercial communications (spam).
- Violation of any applicable laws or regulations, including telemarketing and data privacy laws.
2.2. Unauthorized Access:
Users shall not attempt to gain unauthorized access to any part of the Platform, other user accounts, or related systems or networks.
2.3. Data Misuse:
Users shall not misuse, distribute, or disclose any data obtained through the Platform in any unauthorized manner.
2.4. Interference:
Users shall not interfere with the proper functioning of the Platform or disrupt the services provided to other users.
2.5. Reverse Engineering:
Users shall not attempt to reverse engineer, decompile, or disassemble the Platform or its software.
3. Compliance and Monitoring
3.1. TCPA Compliance:
Users are responsible for ensuring their use of the Platform complies with the Telephone Consumer Protection Act (TCPA) and other applicable telemarketing regulations. The Platform provides features such as AMD and DNC list management to aid in compliance.
3.2. Monitoring:
OmVe reserves the right to monitor User activity on the Platform to ensure compliance with this Policy and to protect the integrity of the Platform.
4. Account Responsibility
4.1. Account Security:
Users are responsible for maintaining the security of their account credentials and for all activities that occur under their account.
4.2. User Roles:
Users must adhere to the permissions and restrictions associated with their assigned user role within the Platform's multi-level user management system.
5. Termination
5.1. Violation:
OmVe may suspend or terminate a User's access to the Platform for any violation of this Policy.
5.2. Discretion:
OmVe reserves the right to terminate or suspend access to the platform at its sole discretion.
6. Disclaimer
6.1.
OmVe provides the platform "as is" and makes no warranties regarding its availability, reliability, or suitability for any particular purpose.
7. Governing Law
7.1.
This Policy shall be governed by and construed in accordance with the laws of Singapore.
8. Modifications
8.1.
OmVe reserves the right to modify this Policy at any time. Users will be notified of any material changes, and continued use of the Platform constitutes acceptance of the modified Policy.
